Landlord with concealed handgun license shoots enraged former tenant using his car as weapon

The Dayton Daily News is reporting that a landlord was forced to shoot a former tenant who had used his car to destroy his property, threaten his tenants, and eventually pin the landlord to a building in his apartment complex.

At 4:43 p.m. Saturday, the landlord of an apartment complex at 317 N. Smithville Road called police to report that a former resident was trespassing on his property, said Dayton police Sgt. Shanon Mason.

The man tried to flee in his Pontiac Sunbird, but the landlord decided to block the car with his own vehicle.

In response, the man drove around the interior of the apartment complex, running over grass, knocking over trash cans and a picnic table and nearly striking a few residents, Mason said.

After the driver ran into a parking post, the landlord tried to take his keys, but he backed his car into the landlord, pinning him against an apartment building, Mason said.

The landlord, who has a carrier's permit, pulled out his .380-caliber pistol and shot the driver.

The man drove off, and at 4:52 p.m., an employee at Smokin' Bar-B-Que in the Oregon District – about three miles from the shooting – called police to tell them a man walked in, said he was shot and collapsed, police said.

The driver, who is recovering in a local hospital, will likely be charged with multiple counts of felonious assault, police said.

The landlord did not require treatment for his injuries.

Police say the landlord, who shot at the man twice and struck him at least once, will not face any charges.
