Rep. Grendell Introduces HR 311 to Declare Ohio a Second Amendment Protective State

Rep. Diane Grendell [R] has introduced House Resolution 311 to declare that Ohio is a Second Amendment Protective State.

Co-sponsors include Representatives Ginter, Antani, Vitale, Lang, Riedel, Romanchuk, Lipps, D. Manning, Swearingen, and Richardson.

Here is the text of the resolution:

A R E S O L U T I O N
To declare that Ohio is a Second Amendment Protective State.
BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF OHIO:

WHEREAS, The Bill of Rights of the Ohio Constitution, Article I, Section 4, proclaims, "The people have the right to bear arms for their defense and security"; and

WHEREAS, The Second Amendment to the United States Constitution states, "a well-regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed"; and

WHEREAS, The Supreme Court of the United States, in District of Columbia v. Heller, 554 U.S. 570 (2008), affirmed that the Second Amendment right to keep and bear arms is not connected to service of the militia; and

WHEREAS, The Supreme Court of the United States, in United States v. Miller, 307 U.S. 174 (1939), stated firearms that are part of ordinary military use (weapons of common use) that can contribute to the common defense and are protected by the Second Amendment; and

WHEREAS, There are an estimated nineteen million Americans who lawfully carry concealed firearms, and an estimated three hundred ninety-three million civilian-owned firearms in the United States; and

WHEREAS, Abridging the rights of lawful gun owners does not reduce the criminal use of firearms by violent offenders; and

WHEREAS, Violations of existing laws, statutes, and regulations are already criminal offenses, many being felonies; and

WHEREAS, Gun control laws are not evidence based; now therefore be it

RESOLVED, That we, the members of the House of Representatives of the 133rd General Assembly of the State of Ohio, in adopting this resolution, declare Ohio to be a Second Amendment Protective State; and be it further

RESOLVED, That the Clerk of the House of Representatives transmit a duly authenticated copy of this resolution to the news media of Ohio.

Buckeye Firearms Association wishes to thank Rep. Grendell for introducing this resolution. While it does not have the effect of law, it summarizes why gun owners object to the incessant stream of pointless gun control laws that ignore the reality of crime, do nothing to stop violence, and infringe on Constitutional rights.
